The Mississippi Commission on Environmental Quality (“MCEQ”) and Paradise Ranch RV Resort (“Paradise”) entered into a September 6th Agreed Order (“AO”) relating to alleged failure to obtain a wastewater permit. See Order No. 7149 21.
MCEQ is stated to have notified Paradise of a violation at its RV resort facility (“Facility”) in Tylertown, Mississippi.
A June 28th letter from the Mississippi Department of Environmental Quality (“MDEQ”) to Paradise alleged a violation of MS Code Ann. 49-17-29(2b) which states in part that:
It is unlawful for any person to carry on any of the following activities, unless that person holds a current permit for that activity from the Permit Board as may be required for the disposal of all wastes which are or may be discharged into the waters of the state, or unless that person is exempted from holding a permit by a regulation promulgated by the commission. . .
MDEQ’s Environmental Permits Division is stated to have received a Small Domestic NPDES permit application on August 21, 2020, from Paradise. Such application is stated to be under review. Further, on August 5th, Paradise is stated to have submitted a picture documenting that a discharge pipe had been capped and that wastewater would be trucked offsite for disposal.
A civil penalty of $5,250 is assessed.
