The United States Environmental Protection Agency (“EPA”) and Super Concrete Corporation (“SCC”) entered into a September 7th Consent Agreement and Final Order (“CA”) addressing alleged violations of a Clean Water Act National Pollution Discharge Elimination System (“NPDES”) permit. See Docket No. CWA-03-2017-0024.
SCC is described as an owner and operator of a concrete aggregate processing facility (“facility”) located in Washington, D.C.
The SCC facility is stated to be subject to a Clean Water Act NPDES permit. It is alleged the facility failed to comply with the Clean Water Act and its NPDES permit. The alleged violations include a failure to comply with certain monitoring and reporting obligations found in the permit. The alleged violations are detailed in Exhibit 1 to the CA.
SCC neither admits or denies the factual allegations or conclusions of law contained in the CA.
The CA assesses a civil penalty of $27,250.
The CA also requires that SCC implement and agree to continue to implement by the effective date of the document the “Standard Operating Procedure for NPDES Permit Compliance” which is incorporated as Exhibit 2. Exhibit 2 is described as a compendium of documents which was prepared by SCC.
