The Mississippi Commission on Environmental Quality (“MCEQ”) and Franklin Ready-Mix Concrete, Inc., (“Franklin”) entered into a March 9th Agreed Order (“AO”) addressing an alleged violation of NS Code Ann. 49-17-29 (2)(a). See Order No. 7237 23.
The AO provides that Franklin:
. . . placed waste, namely waste concrete, from a concrete truck into a storm drain on the corner of Chippewa Street and Church Street in Brookhaven, Mississippi, in violation of MS Code Ann. 49-17-29 (2)(a).
Franklin was stated to have been notified by MCEQ on April 4, 2022. By letter dated April 11, 2022, Franklin stated that it had conducted a training session for its employees in response to the alleged violation.
The AO assesses a civil penalty of $1,000.
