The American Bar Association has issued the Fifth Edition of a publication titled:
Environmental Aspects of Real Estate and Commercial Transactions:
Acquisition, Development, and Liability Management (“Publication”)
The editor of the publication is Kevin R. Murray.
The Publication is described as a guide that examines the issues, problems and pitfalls involved in the intersection of real estate, business, and environmental law. It addresses a variety of environmental issues that arise when real estate is developed, operated, sold, or financed.
I authored Chapter 21 in Part 4 which addresses underground storage tanks.
The Publication is divided into four parts which encompass 29 chapters addressing a range of environmental issues relevant to real estate transactions. The four parts include:
- Part 1: Overview of environmental liability
- Part 2: Environmental due diligence – Identification of environmental issues
- Part 3: Issues related to the transactional structure, tax, and business matters
- Part 4: Environmental issues specific to real estate development
